Terms of Use

Please read on to learn the rules and restrictions that govern your use of our website, product, and services (the “Services”). If you have any questions, comments, or concerns regarding these terms or the Services, contact us at benjamin.kadison@gmail.com.

These Terms of Use (the “Terms”) are a binding agreement between you and Pipit (“Pipit,” “we,” and “us”). You must agree to all of the Terms, or you don't have the right to use the Services. Using the Services in any way means you agree to these Terms, and they remain in effect while you use the Services. These Terms include this document as well as our Privacy Policy.

We're constantly trying to improve Pipit, so these Terms may change along with it. We may update them at any time; if we do, we'll update the date at the top of this page and, for material changes, try to notify you directly (email or an in-app notice).

If you don't agree with the new Terms, you're free to reject them — that means you'll no longer be able to use the Services, and you can delete your account at any time. If you use the Services after a change takes effect, that means you agree to the change.

Pipit takes your privacy seriously — see our Privacy Policy for what we collect, why, and how to delete it.

You must be at least 18 years old to create a Pipit account or use the Services. By creating an account, you confirm that you meet this requirement. We do not knowingly permit anyone under 18 to use Pipit; if we learn that an account belongs to someone under 18, we will close it. If you believe someone under 18 has an account, contact us at benjamin.kadison@gmail.com.

You'll need to sign up for an account with an email address and password. You promise to provide accurate, complete, and up-to-date registration information. You may not transfer your account to anyone else without our permission.

If you create or join a household, other household members you've chosen to share an account or goal with can see that shared data — see “Household sharing” below. Pipit doesn't have a concept of authorizing a financial professional or advisor to access your account on your behalf.

You will only use the Services for your own personal, non-commercial use, and only in a manner that complies with all applicable laws. You represent and warrant that you are only providing information about your own accounts, transactions, and finances (or those of a household member who has agreed to share them with you), and that you have the right to do so.

Unless specifically disclosed, you acknowledge that we are not a financial institution (as defined by the Gramm-Leach-Bliley Act, 15 U.S.C. §§ 6801 et seq.), a consumer reporting agency (as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681a(d)), a creditor, credit counselor, debt adjustor, loan servicer, or investment advisor, and that the Services are not a “consumer report” under the FCRA. Information Pipit shows you is not investment, financial, insurance, accounting, legal, or tax advice, and nothing in the Services is an offer or recommendation regarding any security, insurance policy, or investment strategy. We have no role in evaluating your eligibility for credit, insurance, employment, a government license or benefit, or any other purpose for which a consumer report could be used under the FCRA or a similar state law. If your use of the Services would be prohibited by applicable law, you are not authorized to use them — we can't and won't be responsible for use of the Services that breaks the law.

You will not share your account or password with anyone, and you're responsible for protecting the security of your account and for all activity that happens under it, including activity by anyone you share a household with.

You represent, warrant, and agree that you will not:

• Use the Services in a way that infringes anyone's intellectual property or other rights;
• Violate any law or regulation, including export control laws, privacy laws, the FCRA, or the GLBA;
• Use the Services in a way that's harmful, fraudulent, deceptive, threatening, harassing, or otherwise objectionable;
• Jeopardize the security of your Pipit account or anyone else's;
• “Crawl,” scrape, or access the Services or their data programmatically by any automated means other than the app's own interface;
• Attempt to obtain another user's password, account, or other security information;
• Probe, scan, or test the security of the Services, or attempt to breach any authentication measures;
• Interfere with the proper working of the Services, including placing unreasonable load on our infrastructure;
• Use the Services to build a product or service that competes with Pipit; or
• Reverse engineer, decompile, or otherwise attempt to discover the source code or underlying components of the Services.

A violation of any of the above is grounds for suspending or terminating your access to the Services.

The Services — including their design, code, text, graphics, and other materials we provide (the “Content”) — are protected by copyright and other intellectual property laws and owned by Pipit or our licensors. You won't modify, publish, transmit, sell, or create derivative works based on the Services, except for the data that is your own and that the Services let you export.

Anything you enter into Pipit — accounts, transactions, notes, tags, budgets, goals, and so on — is yours. We store and process it to operate the Services for you: to display it back to you, compute summaries and insights from it, and (only where you've opted in) share it with household members you choose.

Pipit lets you share specific accounts, goals, and individual transactions with other members of a household you create or join. Sharing is opt-in per account/goal/transaction — nothing is shared automatically. If you share something, the people you've shared it with can view it (and, for shared accounts' transactions, edit categorization); you're responsible for only sharing what you intend to, with people you trust. Pipit isn't responsible for disputes between members of the same household over shared data.

If you opt in to anonymized benchmarking (Settings → Preferences), we may include your data, stripped of anything that identifies you, in aggregated statistics shown to other users (e.g. net-worth percentile comparisons) — this is gated so a single opted-in user's data can't be reverse-identified, and you can opt out at any time.

The Services may link to third-party websites or services not owned or controlled by Pipit. We're not responsible for their content, accuracy, or privacy practices. Your bank and account data is retrieved through our data provider, Plaid Inc.; by using Pipit's bank-linking features, you also agree to Plaid's own end-user terms, available at plaid.com/legal.

By using the Services, you grant us and our service providers (including Plaid) the right to access your financial account information on your behalf, with the full authority to retrieve and use that information exactly as you could yourself, for the purpose of providing the Services to you. You may revoke this at any time by disconnecting a bank connection or deleting your account. YOU ACKNOWLEDGE AND AGREE THAT WHEN WE OR OUR SERVICE PROVIDERS ACCESS YOUR FINANCIAL ACCOUNT INFORMATION, WE ARE ACTING AT YOUR REQUEST AND WITH YOUR AUTHORIZATION, AND NOT ON BEHALF OF YOUR FINANCIAL INSTITUTION.

We're always trying to improve Pipit, so it may change over time. We may add, change, or remove features, or suspend or discontinue parts of the Services, at our discretion. We'll try to give notice of material changes that would adversely affect you, but this isn't always practical.

Pipit Plus is a paid monthly subscription, billed in advance through our payment processor, Stripe. Subscriptions renew automatically each billing period until canceled. You can cancel anytime from Settings → Billing; your Plus access continues through the remainder of the period you've already paid for, and no further charges will occur after that. Fees are non-refundable except where required by law. We may change subscription pricing going forward — if we do, we'll give current subscribers reasonable notice before the new price takes effect at their next renewal, and continued use after that point means you accept the new price.

You're free to do that at any time, either by deleting your account from Settings → General or by contacting us at benjamin.kadison@gmail.com. Account deletion is self-serve and takes effect immediately — your data (and any active subscription) is deleted right away, not on a delay.

We may also suspend or terminate your access for violating these Terms, at our discretion. We'll try to give advance notice where practical, but may not if we determine it would be impractical, unlawful, or harmful to someone's safety or to Pipit's rights or property.

Pipit displays your own financial data and computed summaries of it (budgets, trends, insights). Nothing in the Services is investment, tax, legal, accounting, or financial advice, or a substitute for the advice of a qualified professional — verify anything important against your actual account statements before acting on it. Balances and transactions come from your financial institutions via Plaid and may be delayed, incomplete, or occasionally wrong; your bank's own records are always authoritative, not Pipit's copy of them.

The services and content are provided by pipit on an “as-is” basis, without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, or that the services will be uninterrupted, secure, or error-free. some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.

To the fullest extent allowed by applicable law, under no circumstances and under no legal theory (including tort, contract, strict liability, or otherwise) shall pipit be liable to you for (a) any indirect, special, incidental, or consequential damages of any kind, including damages for lost profits, loss of goodwill, computer failure or malfunction, or relating to your data made available through the services, or (b) any amount, in the aggregate, in excess of the greater of (i) $100 or (ii) the amounts paid by you to pipit in connection with the services in the twelve (12) month period preceding the applicable claim. some states do not allow the exclusion or limitation of certain damages, so the above limitation and exclusions may not apply to you.

You agree to indemnify and hold Pipit harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the Services, including actions taken by anyone using your account or a household member you've shared data with, (b) your violation of these Terms, or (c) your infringement of anyone's intellectual property or other rights.

You may not assign, delegate, or transfer these Terms, your rights or obligations under them, or your Pipit account, without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent — for example, if Pipit's operation moves to a newly-formed legal entity.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

Any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for misuse of intellectual property. Arbitration will take place in the county in Texas where you reside, in English. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Any arbitration under these terms will take place on an individual basis: class arbitrations and class actions are not permitted. You and pipit are each waiving the right to a trial by jury or to participate in a class action.

You acknowledge that the Services are subject to U.S. export control laws, and you will not export or re-export them to any country, entity, or individual prohibited under those laws.

You're responsible for any taxes associated with your use of the Services. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of the Terms remain in effect. These Terms are the complete agreement between you and Pipit regarding the Services and supersede any prior agreements on the subject. Failure to enforce any provision isn't a waiver of it.
